Legislators Aim to Expand Educational Options and Opportunity

Grothman, Jacque Offer Tax Credit Proposal for Increased Access to Independent and Religious Schools

Today, Senator Glenn Grothman (R-West Bend) and Representative Andre Jacque (R-Bellevue) announced they will be introducing legislation providing a non-refundable tax credit for religious and independent schools beginning in school year 2012-2013.   The credit will start at $1,500 per year for every first grade student and $2,500 for every ninth grade student.  The following year, second and tenth graders will be added to the program with additional years added each year until all students will be covered by the 2021 school year.

“With the government already subsidizing private education by up to $6,500 per year for Milwaukee residents, the proposal would offer assistance, albeit a lesser amount, for outstate parents who want an alternative to the public schools for their children,” said Grothman.  “Whether their concerns are Wisconsin’s declining test scores, a radical new sex education program pushed through the Legislature last year, or public school teachers proselytizing a liberal political agenda in their schools, it is unfair not to provide a little assistance to independent-minded parents.” 

“The taxpayers already provide over $12,000 per year per child in the government schools, so any parent who is persuaded to enroll their children in the private schools creates a huge tax savings for Wisconsin’s taxpayers,” said Grothman.

“As a proud supporter of charter school expansion, open enrollment for public schools, and non-public school choice it is very important to be consistent in offering families in my district, and across the state, access to the full range of educational alternatives.  When it comes to educational instruction, one type doesn’t fit all,” said Representative Jacque, further noting that the proposal would not reduce state public school funding.  “We should always look at enhancing our state educational offerings to benefit students,” added Jacque.

“Private school enrollment has declined in recent years in part because of the proliferation of 4-year-old kindergarten.  The current budget, which allows for a further expansion of 4-year-old kindergarten despite the state’s fiscal shape, will have a further negative impact on private school enrollment,” said Grothman. 

“This is a frugal and modest proposal that can make a dramatic impact.  Just this week, we’ve heard a bill dedicating $7,500 in government funds to parents who send their children to charter schools,” said Jacque.

State Supreme Court To Rule On Gay Marriage Ban

NOTE: The Traditional Marriage Amendment was supported by 59% of Wisconsin's voters in 2006.

AAAMADISON, Wis. -- The Wisconsin Supreme Court is expect to rule this week on the state’s gay marriage ban.
The court will decide if the 2006 constitutional amendment banning gay marriage and civil unions was properly put to voters. A lawsuit claims the measure violated the constitution because it asked two questions at the same time: whether to limit marriage to one man and one woman, and whether to outlaw any similar legal status for unmarried individuals.

According to the state Constitution, all ballot questions should be limited to a single subject.
A Dane County judge ruled the question was valid in 2008.
If the court strikes down the amendment, it would not legalize gay marriage because state law already defines marriage as a union between a husband and wife.

MADISON, Wis. -- The Wisconsin Supreme Court heard arguments Tuesday that the state's ban on gay marriage should be set aside because lawmakers didn't follow the right procedure to amend the state constitution.

Attorney Lester Pines told justices on Tuesday that voters must be asked separately about every change proposed to the constitution, and that didn't happen during the 2006 vote.

In 2006 when voters got the controversial constitutional amendment banning gay marriage, they were asked one question with two parts, and passed it.

University of Wisconsin-Oshkosh political science professor William McConkey contends that the procedure was illegal because voters should have been able to vote on each part separately.

"The first section (of the amendment question) relates to the definition of marriage -- only a marriage between one man and one woman. The second section relates to something other than that," Pines, McConkey's attorney, told the court's justices.

The second section outlaws giving legal status like or similar to marriage to unmarried couples, essentially banning civil unions.

But Pines said the two issues are distinct and separate from one another and that lawmakers violated state law by holding only one vote on them.

The state attorney general denies that.
Assistant Attorney General Lewis Beilin said the constitution was correctly amended because the two parts of the amendment question were closely related.

Beilin also asserted that McConkey has no right to bring a challenge because he can't claim an injury.
The state said McConkey has no injury to claim, because even if the two pieces of the amendment had been separate, he would have voted the same way.

"McConkey conceded that even if the two propositions in this amendment were presented separately he would have voted no to each one," Beilin told the court.

The court is expected to rule by the summer. Even if the court overturns the constitutional ban on gay marriage, it will still be illegal under state law.

The National Popular Vote Bill was circulated for co-sponsorship today.

This is a direct attack on our U.S. Constitution. Long story short it would change the way we elect our President. It would create a situation in which a President could be elected with only 20% of the voting population instead of the current 51% of the electoral college. If there are 20 candidates running for president the winner would only need a majority (which could be 20% or less depending on how the votes are split up) in order to win. The candidates would only need to focus on the high populous areas in order to win, creating a VERY slanted playing field. Eagle Forum is planning a teen event at the State Capitol NEXT WEEK on Wednesday, January 13th. ADULTS who are interested in reigning in our state government are also invited. The Eagle Forum of Wisconsin, VP, Joan Tatarsky, is bringing her special barbecue for our sandwiches!

The Senate Education Committee is scheduled for a public hearing on the 13th. This will give us an opportunity to attend a hearing, to take a Capitol tour (11AM), and to visit the legislative offices of your choice.

We will meet in Room 400 SE at 9 AM (subject to change) to discuss how to lobby and talk about several bills, including a bill to amend our state Constitution to allow Wisconsin to "opt-out" of the proposed federal health-care plan!

Wisconsin Ponders Replacing Abstinence-Only Program with Contraceptive Sex Ed

MADISON, Wisconsin, October 30, 2009 (LifeSiteNews.com) - A law set for consideration in the Wisconsin state legislature aims to replace the abstinence-only curriculum used in the state's public schools with one that educates students on the use of condoms and contraceptives.

The Healthy Youth Act (AB-458 and SB-324), introduced by Democrat state Rep. Tamara Grigsby and Sen. Lena Taylor last month, aims to establish a contraceptive-promoting state curriculum for all schools that have a Human Growth and Development Program. The curriculum is billed as giving "age-appropriate, medically accurate information" on how to prevent unwanted pregnancy and sexually transmitted disease.

Under current Wisconsin law, public school sex ed classes are abstinence-based. The new law would most immediately affect the approximately six in ten public schools currently using a sex education program, according to the Pierce County Herald.

The Assembly Education Committee on Tuesday voted to recommend the Healthy Youth Act on an 8-5 party-line vote, and is now set to be scheduled for debate on the Assembly floor. The Senate Education Committee held a hearing on the bill on Thursday. Both chambers are controlled by Democrats.

Planned Parenthood of Wisconsin lauded the bill.

"Abstinence just does not work to change teen behavior. Studies have concluded that," said Chris Taylor, public policy director for Planned Parenthood Advocates of Wisconsin.

But local pro-life groups, including Pro-life Wisconsin, Wisconsin Family Action, and Wisconsin Right to Life, argue that the legislation would not stem the state's rising pregnancy and STD rates, but only increase the number of unwanted pregnancies and abortions.

Wisconsin Right to Life legislative director Susan Armacost told legislators in a memo that the bill "would require that students be taught about a number of activities that could endanger their health and could result in a growing number of teen sexually transmitted diseases, pregnancies and abortions."

"It's going to be an uphill battle," Matt Sande, the legislative director of Pro-Life Wisconsin, told LifeSiteNews.com (LSN). "We're hopeful that some of the more moderate Senate Democrats will see that this is overkill, it's a one-size-fits-all mandate that violates the principle of local control."

Said Sande: "It's not just talking about [contraception], it's actually very precise instruction on how to use it. Make no mistake, there are going to be nurses up there demonstrating how to use this contraception. It'll be graphic."

The Assembly bill also stresses that the program must not "promote bias against pupils of any race, gender,sexual orientation ... or against sexually active pupils."

In testimony against the Senate bill at a public hearing Thursday, Sande pointed out that the measure would allow physicians and nurses visiting schools under the Volunteer Health Provider Program to discuss reproductive health - a topic that was previously disallowed. This, he said, would leave children vulnerable to Planned Parenthood employees advocating contraception and abortion in schools.
